Wentling’s Bill to Repeal Frozen Dessert Law Passes House
HARRISBURG – Rep. Parke Wentling (R-Mercer) announced his bill to ease unnecessary and costly testing burdens for employers has passed the House.
House Bill 953, which would repeal Act 215 of 1965 known as the Frozen Dessert Law, overwhelmingly passed the House Monday.
“This law is out of date. Eliminating it will save businesses time and money while still maintaining the safety of frozen desserts and protecting customers,” Wentling said. “Other laws and regulations ensuring the safety of frozen desserts remain in effect. My bill only repeals one archaic and unnecessary law hurting businesses in the Commonwealth.
“This issue was brought to me by a constituent who runs a custard shop in western Mercer County. Repealing this obsolete law will help him and other Pennsylvania business owners.”
Current regulation states that businesses are required to conduct monthly standard plate count and coliform testing of each barrel of each soft serve and milkshake machine at a private laboratory, as well as follow testing protocols required in the milk sanitation regulations. After more than 3 million tests, there has never been an outbreak identified in frozen desserts at the retail level.
The bill now heads to the Senate for consideration.
